Welcome to the website of BioFi AG, a Swiss company with its official address at c/o Walder Wyss AG, Aeschenvorstadt 48, 4051 Basel and company registration number CHE-342.717.909 (“BioFi”, “We”, “Us”, or “Our”.) and to the website of its technology platform EndogenicsTM (individually the “Website” and together the “Websites”).

 

Our privacy policy (the Privacy Policy) explains the information We collect, how We use and share it when you use our Websites or our EndogenicsTM platform (“Endogenics”, and together with the Website, the “Services”).

4. Your rights

4.1 Withdrawing permission

Where We process your information based on our legitimate interests, you can object to this processing in certain circumstances. In such cases, We will cease processing your information unless We have compelling legitimate grounds to continue processing or where it is needed for legal reasons.

 

4.5 Data transfer (data portability)

You can request Us to obtain your personal data in a structured, current and machine-readable form or transfer it to another organization when the data processing takes place automatically and is based on permission or an agreement.

 

4.6 Complaint with the competent authorities

You can also submit a complaint to the Swiss Federal Data Protection and Information Commissioner (FDPIC) when you believe that BioFi violates your privacy rights.

 

5. Retention of Information

5.1 Retention period

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted. In addition, you can delete some items of information without deleting your account. Following your deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems. Additionally, We may retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms of Service and take other actions permitted by law. The information We retain will be handled in accordance with this Privacy Policy.

5.2 Aggregation

Information connected to you that is no longer necessary and relevant to provide our Services may be de-identified or aggregated with other non-personal data to provide insights which are commercially valuable to BioFi, such as statistics of the use of the Services.

We take several measures to safeguard the collection, transmission and storage of the data We collect. We employ reasonable protections for your information that are appropriate to its sensitivity.

7. Links to other websites

The Services may contain links to other websites not operated or controlled by BioFi, including social media services or links that You or other users add within Endogenics (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the respective privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these Third Party Sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

8. Opt-out of commercial communications

You may opt out of commercial communications by following the opt out or unsubscribe instructions contained in commercial communications that we send you. Please note, however, that you may continue to receive certain communications as described in the “To communicate with you” section after opting out of commercial communications, for example security alerts.

9. Limitation of liability

Even though BioFi has taken reasonable commercial steps and efforts to prevent personal information from being accessed, used, intercepted or disclosed by unauthorized individuals in violation of this Privacy Policy, you should know and you acknowledge that BioFi cannot fully eliminate security risks associated with your information. Subject to the terms of any specific supply or other services agreement, you expressly acknowledge and agree that uploading, posting, providing, storing, transmitting, sharing and/or allowing access to personal information and other information through Our Services and the use of the Services, are all done at your sole risk and responsibility. You expressly acknowledge that except to the extent expressly provided for in any agreements of services applicable to you, BioFi is not liable for (i) any indirect, consequential, or punitive damages, costs, or liabilities whatsoever arising out of or resulting from your use of Our Services or (ii) any loss, disclosure or use of your personal information or other information.

10. Privacy Policy Information

BioFi reserves the right to modify this Privacy Policy at any time. Please review it occasionally. If BioFi makes changes to this Privacy Policy, the updated Privacy Policy will be posted on the Services in a timely manner and, if We make material changes, We will provide prominent notice. If you object to any of the changes to this Privacy Policy, you should stop using the Services and, if you have created one, you should delete your account.
